What do we use your data for?

Some of the data is collected to ensure that the website is provided without errors. Other data may be used to analyze your user behavior.

Some of the contact data provided is used to regularly send you information and offers individually tailored to your interests. What rights do you have regarding your data?

You have the right at any time to obtain, free of charge, information about the origin, recipients and purpose of your stored personal data. You also have the right to request correction or deletion of this data. If you have given consent to data processing, you may withdraw this consent at any time with effect for the future. In addition, under certain circumstances, you have the right to request restriction of the processing of your personal data. You also have the right to lodge a complaint with the competent supervisory authority.

You may contact us at any time regarding this and any other questions relating to data protection.

2. General Information and Mandatory Information

Data Protection

The operators of these pages take the protection of your personal data very seriously. We treat your personal data confidentially and in accordance with statutory data protection regulations and this Privacy Policy.

When you use this website, various personal data is collected. Personal data means data by which you can be personally identified. This Privacy Policy explains what data we collect and what we use it for. It also explains how and for what purpose this is done.

We point out that data transmission on the internet (e.g. when communicating by email) may have security gaps. Complete protection of data against access by third parties is not possible.

Information on the Controller

The controller responsible for data processing on this website is:

BWS Education GmbH
Untere Bahnhofstraße 9
09380 Thalheim

Email: info@medplattform.com

The controller is the natural or legal person who, alone or jointly with others, determines the purposes and means of the processing of personal data (e.g. names, email addresses, etc.).

Storage Period

Unless a more specific storage period has been stated within this Privacy Policy, your personal data will remain with us until the purpose for the data processing no longer applies. If you assert a legitimate request for deletion or withdraw consent to data processing, your data will be deleted unless we have other legally permissible reasons for storing your personal data (e.g. retention periods under tax or commercial law); in the latter case, deletion will take place once these reasons no longer apply.

Information on Data Transfer to the USA

Our website includes, among other things, tools from companies based in the USA. When these tools are active, your personal data may be transferred to the US servers of the respective companies. We point out that the USA is not considered a secure third country within the meaning of EU data protection law. US companies are required to disclose personal data to security authorities without you, as the data subject, being able to take legal action against this. It can therefore not be ruled out that US authorities (e.g. intelligence services) may process, analyze and permanently store your data located on US servers for surveillance purposes. We have no influence over these processing activities.

Withdrawal of Your Consent to Data Processing

Many data processing operations are only possible with your express consent. You may withdraw consent already given at any time. The lawfulness of the data processing carried out up to the point of withdrawal remains unaffected by the withdrawal.

Right to Object to Data Collection in Special Cases and to Direct Marketing (Art. 21 GDPR)

IF DATA PROCESSING IS CARRIED OUT ON THE BASIS OF ART. 6(1)(E) OR (F) GDPR, YOU HAVE THE RIGHT AT ANY TIME, ON GROUNDS RELATING TO YOUR PARTICULAR SITUATION, TO OBJECT TO THE PROCESSING OF YOUR PERSONAL DATA; THIS ALSO APPLIES TO PROFILING BASED ON THESE PROVISIONS. THE RESPECTIVE LEGAL BASIS ON WHICH PROCESSING IS BASED CAN BE FOUND IN THIS PRIVACY POLICY. IF YOU OBJECT, WE WILL NO LONGER PROCESS YOUR AFFECTED PERSONAL DATA UNLESS WE CAN DEMONSTRATE COMPELLING LEGITIMATE GROUNDS FOR THE PROCESSING THAT OVERRIDE YOUR INTERESTS, RIGHTS AND FREEDOMS, OR THE PROCESSING SERVES THE ESTABLISHMENT, EXERCISE OR DEFENSE OF LEGAL CLAIMS (OBJECTION PURSUANT TO ART. 21(1) GDPR).

IF YOUR PERSONAL DATA IS PROCESSED FOR THE PURPOSE OF DIRECT MARKETING, YOU HAVE THE RIGHT TO OBJECT AT ANY TIME TO THE PROCESSING OF PERSONAL DATA CONCERNING YOU FOR THE PURPOSE OF SUCH MARKETING; THIS ALSO APPLIES TO PROFILING TO THE EXTENT THAT IT IS RELATED TO SUCH DIRECT MARKETING. IF YOU OBJECT, YOUR PERSONAL DATA WILL NO LONGER BE USED FOR DIRECT MARKETING PURPOSES (OBJECTION PURSUANT TO ART. 21(2) GDPR).

Right to Lodge a Complaint with the Competent Supervisory Authority

In the event of infringements of the GDPR, data subjects have the right to lodge a complaint with a supervisory authority, in particular in the Member State of their habitual residence, their place of work or the place of the alleged infringement. The right to lodge a complaint is without prejudice to any other administrative or judicial remedies.

Right to Data Portability

You have the right to have data that we process automatically on the basis of your consent or in fulfillment of a contract handed over to you or to a third party in a commonly used, machine readable format. If you request the direct transfer of the data to another controller, this will only be done to the extent technically feasible.

SSL or TLS Encryption

For security reasons and to protect the transmission of confidential content, such as orders or inquiries that you send to us as the site operator, this site uses SSL or TLS encryption. You can recognize an encrypted connection by the fact that the address line of the browser changes from "http://" to "https://" and by the lock symbol in your browser line.

If SSL or TLS encryption is activated, the data you transmit to us cannot be read by third parties.

Encrypted Payment Transactions on This Website

If, after concluding a fee based contract, there is an obligation to transmit your payment data to us (e.g. account number for direct debit authorization), this data is required for payment processing.

Payment transactions using common means of payment (Visa/MasterCard, direct debit) are carried out exclusively via an encrypted SSL or TLS connection. You can recognize an encrypted connection by the fact that the address line of the browser changes from "http://" to "https://" and by the lock symbol in your browser line.

With encrypted communication, your payment data that you transmit to us cannot be read by third parties.

Access, Deletion and Correction

Within the framework of the applicable statutory provisions, you have the right at any time to obtain, free of charge, information about your stored personal data, its origin and recipients and the purpose of the data processing and, where applicable, a right to correction or deletion of this data. You may contact us at any time regarding this and any other questions relating to personal data.

Right to Restriction of Processing

You have the right to request restriction of the processing of your personal data. You may contact us at any time for this purpose. The right to restriction of processing exists in the following cases:

·  If you dispute the accuracy of your personal data stored by us, we usually need time to verify this. For the duration of the review, you have the right to request restriction of the processing of your personal data.

·  If the processing of your personal data was/is unlawful, you may request restriction of data processing instead of deletion.

·  If we no longer need your personal data, but you need it for the exercise, defense or establishment of legal claims, you have the right to request restriction of the processing of your personal data instead of deletion.

·  If you have lodged an objection pursuant to Art. 21(1) GDPR, a balancing of your interests and ours must be carried out. As long as it has not yet been determined whose interests prevail, you have the right to request restriction of the processing of your personal data.

If you have restricted the processing of your personal data, this data may, apart from being stored, only be processed with your consent or for the establishment, exercise or defense of legal claims or for the protection of the rights of another natural or legal person or for reasons of important public interest of the European Union or a Member State.

Persistent cookies remain stored on your end device until you delete them yourself or they are automatically deleted by your web browser.

In some cases, cookies from third party companies may also be stored on your end device when you enter our site (third party cookies). These enable us or you to use certain services of the third party company (e.g. cookies for processing payment services).

You can set your browser so that you are informed about the setting of cookies and only allow cookies in individual cases, exclude the acceptance of cookies for certain cases or in general, and activate the automatic deletion of cookies when closing the browser. If cookies are disabled, the functionality of this website may be limited.

Where cookies from third party companies or for analytics purposes are used, we will inform you separately in this Privacy Policy and, where applicable, request your consent.

If you send us inquiries via the contact form, your details from the inquiry form, including the contact data you provide there, will be stored by us for the purpose of processing the inquiry and in the event of follow up questions. We do not disclose this data without your consent.

In all other cases, processing is based on our legitimate interest in effectively processing the inquiries addressed to us (Art. 6(1)(f) GDPR) or on your consent (Art. 6(1)(a) GDPR) if this has been requested.

The data you enter in the contact form will remain with us until you request its deletion, withdraw your consent to storage or the purpose for data storage no longer applies (e.g. after your inquiry has been fully processed). Mandatory statutory provisions, in particular retention periods, remain unaffected.

If you contact us by email, telephone or fax, your inquiry, including all personal data arising from it (name, inquiry), will be stored and processed by us for the purpose of handling your request. We do not disclose this data without your consent.

4. Analytics Tools and Advertising

Google Tag Manager

We use Google Tag Manager. The provider is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland.

Google Tag Manager is a tool that enables us to integrate tracking or statistics tools and other technologies on our website. Google Tag Manager itself does not create user profiles, does not store cookies and does not carry out any independent analyses. It is used solely for the administration and deployment of the tools integrated through it. However, Google Tag Manager records your IP address, which may also be transferred to Google's parent company in the United States.

The use of Google Tag Manager is based on Art. 6(1)(f) GDPR. The website operator has a legitimate interest in the quick and uncomplicated integration and administration of various tools on its website. If corresponding consent has been requested, processing is carried out exclusively on the basis of Art. 6(1)(a) GDPR; consent may be withdrawn at any time.

Google Analytics

This website uses functions of the web analytics service Google Analytics. The provider is Google Ireland Limited ("Google"), Gordon House, Barrow Street, Dublin 4, Ireland.

Google Analytics enables the website operator to analyze the behavior of website visitors. In doing so, the website operator receives various usage data, such as page views, length of stay, operating systems used and origin of the user. This data may be combined by Google into a profile assigned to the respective user or their end device.

Google Analytics uses technologies that enable the recognition of the user for the purpose of analyzing user behavior (e.g. cookies or device fingerprinting). The information collected by Google about the use of this website is generally transmitted to a Google server in the USA and stored there.

This analytics tool is used on the basis of Art. 6(1)(f) GDPR. The website operator has a legitimate interest in analyzing user behavior in order to optimize both its website offering and its advertising. If corresponding consent has been requested (e.g. consent to the storage of cookies), processing is carried out exclusively on the basis of Art. 6(1)(a) GDPR; consent may be withdrawn at any time.

Data transfer to the USA is based on the standard contractual clauses of the EU Commission. Details can be found here: https://privacy.google.com/businesses/controllerterms/mccs/.

IP Anonymization

We have activated the IP anonymization function on this website. This means that your IP address is shortened by Google within Member States of the European Union or in other contracting states of the Agreement on the European Economic Area before transmission to the USA. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and shortened there. On behalf of the operator of this website, Google will use this information to evaluate your use of the website, compile reports on website activity and provide the website operator with other services relating to website activity and internet usage. The IP address transmitted by your browser as part of Google Analytics will not be merged with other Google data.

Browser Plugin

You can prevent Google from collecting and processing your data by downloading and installing the browser plugin available at the following link: https://tools.google.com/dlpage/gaoptout?hl=de.

More information on how Google Analytics handles user data can be found in Google's Privacy Policy: https://support.google.com/analytics/answer/6004245?hl=de.

Data Processing Agreement

We have concluded a data processing agreement with Google and fully implement the strict requirements of the German data protection authorities when using Google Analytics.

Storage Period

Data stored by Google at user and event level that is linked to cookies, user identifiers (e.g. User ID) or advertising IDs (e.g. DoubleClick cookies, Android advertising ID) is anonymized or deleted after 14 months. Details can be found at the following link: https://support.google.com/analytics/answer/7667196?hl=de

Google Ads

The website operator uses Google Ads. Google Ads is an online advertising program of Google Ireland Limited ("Google"), Gordon House, Barrow Street, Dublin 4, Ireland.

Google Ads enables us to display advertisements in the Google search engine or on third party websites when the user enters certain search terms in Google (keyword targeting). In addition, targeted advertisements can be displayed based on the user data available at Google (e.g. location data and interests) (audience targeting). As the website operator, we can quantitatively evaluate this data, for example by analyzing which search terms led to the display of our advertisements and how many ads led to corresponding clicks.

Google Ads is used on the basis of Art. 6(1)(f) GDPR. The website operator has a legitimate interest in marketing its services and products as effectively as possible.

Data transfer to the USA is based on the standard contractual clauses of the EU Commission. Details can be found here: https://privacy.google.com/businesses/controllerterms/mccs/.

5. Email Information

Newsletter Data

If you create a user account on our website or use our services, we collect and process your email address to the extent necessary for establishing, carrying out or handling the user relationship. This includes, in particular, emails regarding registration, account management, contract processing, the security of your user account, technical notices, changes to our services and other contract related information.

In addition, we also use your email address, which we received in connection with registration, conclusion of a contract or use of our services, to send you information about our own similar products, services, functions, content, offers and news relating to our platform by email. This may include, in particular, information about new or expanded platform functions, new content, product information, usage options, training offers or comparable own services.

Such email information is sent on the basis of our legitimate interest in informing our users and customers about our own similar services pursuant to Art. 6(1)(f) GDPR in conjunction with Section 7(3) UWG. Your email address will not be disclosed to third parties for advertising purposes.

You may object to the use of your email address for sending such promotional email information at any time with effect for the future without incurring any costs other than transmission costs according to the basic rates. To do so, simply click the "unsubscribe" link included in each corresponding email, for example. Alternatively, you may also declare your objection at any time using the contact details provided in the legal notice.

After your objection, we will no longer use your email address for sending promotional email information or existing customer newsletters. The lawfulness of the data processing carried out up to the point of objection remains unaffected by the objection.

Contract related and technically necessary emails that are required for the use of your account, performance of the contract, security of the platform or fulfillment of legal obligations remain unaffected by an objection to promotional email information. You will continue to receive these emails to the extent that they are required for the user or contractual relationship.

The data used for sending email information is stored for as long as your user account exists or for as long as this is necessary for the purposes stated. If you object to receiving promotional email information, your email address may be stored in a suppression list in order to reliably prevent future promotional mailings. Storage in the suppression list is carried out exclusively for this purpose and on the basis of our legitimate interest pursuant to Art. 6(1)(f) GDPR in complying with legal requirements and effectively implementing your objection. The data from the suppression list will not be merged with other data. Storage in the suppression list is not limited in time. You may object to the storage if your interests outweigh our legitimate interest.
